These Terms of Use (“Terms”) govern your access to and use of the website located at https://tanresorts.com and any related online services that link from these Terms (collectively, the “Site”). 

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you may not use the Site.

1. Eligibility and Use of the Site

1.1 Eligibility
 You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use the Site. By using the Site, you represent that you meet this requirement.

1.2 Permitted Use
 You may use the Site only for lawful purposes and in accordance with these Terms. In connection with your use of the Site, you agree not to:

  • Violate any applicable law or regulation;
  • Use the Site to send spam, malware, or any harmful or disruptive code;
  • Attempt to gain unauthorized access to the Site, our servers, or associated systems;
  • Interfere with or disrupt the operation of the Site;
  • Copy, scrape, or use any automated system to access the Site for purposes not expressly permitted by these Terms; 
  • Decompile, disassemble or reverse engineer any of the software included in the Site; 
  • Copy, reproduce, modify, adapt, translate, distribute, or sell any part of the Site or its content, use any logo, trademark, or branding from the Site, or frame, mirror, or deep-link to any part of the Site, in each case without our prior written consent;
  • Engage in any conduct that: 
    • Is fraudulent, false, misleading or deceptive; 
    • infringes, misappropriates or violates any third party’s patent, copyright, trademark, trade secret or other intellectual property rights; 
    • Is defamatory, obscene, vulgar or offensive.

1.3 Accuracy of Information
You are responsible for ensuring that any information you provide to us through the Site (including contact details, reservation information, and property-owner inquiries) is accurate, complete, and current.

2. Reservations 

2.1 Reservations and Booking Engines

The Site may allow you to view properties, check availability, make reservations or access third-party booking engines or reservation systems. Any reservation or purchase you make through a third-party system is subject to that provider’s terms and conditions, cancellation policies, and privacy practices.

2.2  Reservations made on the Site

Reservations made on the site are subject to the following terms:

2.2.1 Cancellation Policy

All reservations are subject to the cancellation policy of the individual hotel or property (each, a “Property”) where the stay will occur. Please review the applicable cancellation policy during the reservation process. If you made a reservation through a third party and wish to cancel it, please contact that third party.

2.2.2 Payment / Deposit

All reservations must be guaranteed with a valid major credit card, or an alternative Property-approved form of payment, such as an advance deposit. Except for when making a reservation for a prepaid rate, you will be charged during your stay rather than at the time of making a reservation. In some situations a Property may require a deposit, in which case the deposit requirement and amount will be disclosed at the time of making the reservation. You may also be charged as disclosed in the Property’s cancellation policy (except as noted in the Cancellation Policy section above).

2.2.3 No Arrangements for Prohibited Persons

The United States Department of Treasury maintains and publishes lists of “prohibited persons” who are government officials, residents of certain embargoed countries, terrorists or drug traffickers (“Sanctions”). There are limits on our ability to provide services to those prohibited persons pursuant to the Sanctions. You agree you are not a prohibited person and you agree not to make arrangements for any such prohibited persons to stay at, use or tour any Property, unless such prohibitions do not apply to the location, pursuant to a license, permit, or exclusion under the Sanctions.

2.2.4 Currency

If you choose to display a rate on the Site in a currency other than U.S Dollars, the rate displayed is converted for comparison purposes only using a regularly updated exchange rate. Except as noted below, guests are charged in U.S. Dollars. 

Certain hotels may operate in a currency other than U.S. Dollars. Those hotels convert the U.S. Dollar rate to such other currency, using the hotel’s exchange rate, at the time you are charged. For example, a hotel may show pricing on the Site in U.S. Dollars even though the hotel may operate in Mexican Pesos.  In such a situation, the hotel would convert the applicable amount from U.S. Dollars to Mexican Pesos using the hotel’s exchange rate, and you would be charged the Mexican Pesos amount.

Please contact us or the applicable hotel for additional information regarding currencies and exchange rates used at hotels.

2.3 Legitimate Reservations Only
You agree to use any reservation tools or links on the Site only to make legitimate reservations for yourself or for another person for whom you are legally authorized to act. You agree not to make any speculative, false, or fraudulent reservations or any reservations in anticipation of demand.

2.4 Right to Cancel or Refuse Service
We reserve the right, in our sole discretion, to cancel or modify reservations or deny access to the Site if we believe that:

    • A reservation is or may be fraudulent, abusive, or made in error;
    • You have violated these Terms; or
    • It is otherwise necessary to protect ourself, a property, or other guests.
3. Third-Party Services

The Site may contain links to third-party websites, services, or content that we do not own or control (including booking platforms, travel partners, and social media). We are not responsible for the content, terms, or privacy practices of those third parties. Your use of third-party sites and services is at your own risk and subject to their terms.

4. Intellectual Property

4.1 Ownership
All content and materials on the Site, including text, images, photographs, graphics, logos, icons, videos, audio clips, designs, and layouts, are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

4.2 Limited License
We grant you a limited, non-exclusive, revocable, non-transferable license to access and use the Site for your personal, non-commercial use only, in accordance with these Terms.

5. User Content

5.1 Your Responsibility

The Site mayIf the Site allows you to submit content (such as reviews, comments, or testimonials).  You are solely responsible for any content you submit and for ensuring you have the rights to share it.  We may remove any content at our discretion.

5.2 License to TAN Resorts
By submitting content, you grant us a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display that content in connection with the Site and our business, in any media now known or later developed.

6. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, share and protect your personal information.

7. Disclaimers

7.1 No Warranty
The Site And All Content On It Are Provided On An “as Is” And “as Available” Basis, Without Any Warranties Of Any Kind, Whether Express, Implied, Or Statutory, Including But Not Limited To Warranties Of Title, Non-infringement, Merchantability, Or Fitness For A Particular Purpose.

7.2 No Guarantee of Accuracy
We try to keep information on the Site accurate and up to date, but we do not guarantee that all content (including rates, descriptions, availability, or offers) is complete, accurate, or current. Any use of the Site and reliance on its content is at your own risk.

7.3 No Guarantee of Uninterrupted Access
We do not guarantee that the Site will be uninterrupted, secure, or free from errors, viruses, or other harmful components.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

8. Limitation of Liability; Release

To The Fullest Extent Permitted By Applicable Law:

8.1: In No Event Will We, Our Affiliates, Or Our Or Their Respective Directors, Officers, Employees, Or Agents Be Liable For Any Indirect, Incidental, Consequential, Special, Exemplary, Or Punitive Damages, Or For Any Loss Of Profits, Revenue, Data, Or Goodwill, Arising Out Of Or In Connection With Your Use Of (or Inability To Use) The Site, Even If Advised Of The Possibility Of Such Damages.

8.2: Our Total Aggregate Liability For Any Claims Arising Out Of Or Relating To The Site Or These Terms Will Not Exceed The Greater Of: (a) One Hundred U.s. Dollars (us $100); Or (b) The Amount You Paid Directly To Us Through The Site In Connection With A Transaction That Results In Our Liability To You.

8.3: Nothing In These Terms Limits Or Excludes Any Liability That Cannot Be Limited Or Excluded Under Applicable Law, Such As Liability For Fraud, Fraudulent Misrepresentation, Or, Where Applicable, Personal Injury Or Death Caused By Our Negligence.

8.4: By Utilizing The Site, You, And (if Applicable) Each Of Your Affiliates And Your And Their Respective Licensees, Directors, Officers, Employees, And Agents Hereby Fully And Forever Release And Discharge Us, As Well As Our Affiliates, And Our And Their Respective Licensees, Directors, Officers, Employees, And Agents, From Any And All Claims, Whether Or Not Caused By Or Contributed To By The Negligence Of Any Of Us Or Them, And Whether Now Known Or Suspected, Which Existed Or May Have Existed, Or Which Do Exist Or Which Hereafter Can, Shall Or May Exist, Based On Any Facts, Events Or Omissions Occurring From Any Time On Or Prior To The Effective Date Of This Agreement And/or Any Modifications Of This Agreement Arising Out Of, Concerning, Pertaining Or Relating In Any Manner To Your Use Of The Site.

9. Indemnification

You agree to indemnify, defend, and hold us harmless, as well as our affiliates, and our and their respective licensees, directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Site;
  • Your violation of these Terms; 
  • Your content provided to the site; 
  • Your violation of applicable law; or
  • Your violation of any rights of another person or entity.

10. Changes to the Site and to These Terms

10.1 Changes to the Site
We may modify, suspend, or discontinue any part of the Site at any time, with or without notice, and without liability to you.

10.2 Changes to the Terms
We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page. The updated Terms will be effective when posted, unless a later effective date is stated. Your continued use of the Site after any changes is your agreement to and acceptance of updated Terms.

10.3  Additional Terms
Additional terms and conditions may apply to making reservations, and/or engaging in purchases and/or other transactions or activities on or through the Site. You agree to comply with the terms and conditions set forth herein and any and all such applicable additional terms and conditions.

11. Governing Law and Dispute Resolution

11.1 Governing Law
These Terms and your use of the Site are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law principles. If you are accessing the Site from another country, local mandatory consumer protection laws may also apply.

11.2 Jurisdiction and Venue
You agree that any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, USA, and you consent to the personal jurisdiction of those courts.

11.3  Waiver of Jury Trial and Class Actions
YOU ACKNOWLEDGE AND AGREE THAT YOU AND WE ARE EACH WAIVING ANY RIGHT YOU OR WE MAY NOW HAVE OR HEREAFTER POSSESS TO A TRIAL BY JURY OR TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING REGARDING ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE.

12. Termination

We may, in our sole discretion, suspend or terminate your access to the Site at any time and for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Site will immediately cease.

Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will continue to apply.
